The Project Review is a fundamental stage in the process of carrying out construction work, especially in public contracts. It consists of the systematic and detailed analysis of the execution project of all the disciplines involved, with the aim of ensuring that they meet the legal, technical and functional requirements established for the project.
This review aims to identify and correct any errors, omissions or inconsistencies in the project before construction begins, thus helping to prevent risks and uncertainties during the execution of the work, such as missed deadlines and the need for additional work. The design review is conducted by duly qualified professionals and should be carried out by an entity other than the author of the original project. Project review plays an important role in public procurement, guaranteeing the technical integrity of the work and the rational use of public resources.
Design Review is set out in the Public Contracts Code (CCP), Decree-Law no. 18/2008, in its current wording, article 43, no. 2, as well as in Law no. 40/2015, of June 1, which amended Law no. 31/2009, of July 3, article 18, nos. 2 and 3.
"Responsibilities of the client: Whenever the construction work to be carried out is classified in category III or higher, as well as in those cases in which the basic price set out in the specifications falls into class 3 builder license or higher, the public client must ensure that the project is reviewed by an entity duly qualified to carry it out, separate from the creator of the project. The owner of a private construction project in class 3 or higher should endeavor, whenever possible, to have the project reviewed whenever the technical complexity of the construction process justifies it."
Although we are awaiting the entry into effect of a law establishing the framework applicable to design review, in the absence of a legal framework to comply with, the level of review should be defined on the basis of the complexity of the project, or defined in accordance with some expert recommendations, such as: "Instructions for Verifying the Quality of Projects" by the APPC (Portuguese Association of Designers and Consultants), where three levels of intervention are considered for carrying out design review:
Level 1 - Minimum Conformity Assessment;
Level 2 - Project Quality Verification;
Level 3 - Monitoring and Vetting of the Quality of all Project Phases.
